2. Use of AI Services

ChatRep provides autonomous artificial intelligence agents for customer support and sales. You acknowledge that:

• AI Nature: Responses are generated by AI and may occasionally be inaccurate. You are responsible for overseeing the AI's interactions.
• Prohibited Use: You may not use the Service to generate harmful, illegal, or harassing content.
• Training Data: Content you upload (PDFs, URLs) allows the AI to learn. You represent that you have the necessary rights to use this content.

3. Accounts and Registration

To access features, you must register for an account. You agree to provide accurate information and keep your password confidential. You are responsible for all activities under your account.

4. Subscription and Billing

The Service is billed on a subscription basis (Monthly or Yearly). Payments are non-refundable except as provided in our 30-Day Money-Back Guarantee policy. We reserve the right to change pricing with 30 days notice.

5. Intellectual Property

The Service and its original content (excluding content provided by you) remain the exclusive property of Serverlys. Your output generated by the AI is yours to use for your business purposes.

6. Limitation of Liability

To the maximum extent permitted by law, Serverlys shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of the Service.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

• Service Data: Files, URLs, and text you upload to train your AI agents.
• Conversation Logs: Chat history between your AI agents and your end-users for the purpose of service delivery and analytics.
• Usage Data: Log data, device information, and interaction metrics.

2. How We Use Your Information

We use your data to:

• Provide, operate, and maintain our AI services.
• Train your specific custom AI models (we do NOT use your private data to train public foundation models).
• Process transactions and send related information.
• Send administrative information, updates, and security alerts.

3. Data Sharing

We do not sell your personal data. We may share data with:

• Service Providers: Cloud hosting (AWS), payment processors (Stripe), and LLM providers (via secure enterprise APIs with zero-retention policies).

For customers located in the European Economic Area (EEA), we offer a standard Data Processing Agreement (DPA). By using our Enterprise plan, you can request a signed DPA to ensure your compliance obligations are met.

Data Transfers

Data may be processed outside the EEA (specifically in the United States). We rely on Standard Contractual Clauses (SCCs) approved by the European Commission for such transfers to ensure adequate protection.
